Course description

The Single-Cycle Master's Degree in Law has been active for over five years in adapting its contents to the changing needs of the employment context. Already in view of the offer provided to the 2016/2017 cohort, there had been an initial incisive structural intervention, capable of intercepting the challenges of renewal, imposed (also) on the world of legal professions by the advance of the Green Economy and the supranational dimension assumed by the markets. Hence the activation, at the time, of the three Classical, Environment and Territory (still unique in the national panorama) and European and International addresses, inspired by intuitions that have found significant confirmation in subsequent evolutions (just think, as a mere example, of the enormous litigation that has developed in recent years around the Ilva, Tap, Xylella, waste cycle, etc. cases). The further transformations brought about by the Covid-19 pandemic have required a new update of some aspects of the study plan, for example by directing the environmental path towards the further frontier of digital innovation. Green and Innovation, not by chance, are the cornerstones that the PNNR asks to direct research and training in every sector, including the legal one. Hence the second reform intervention, which came into force starting from the 2022-2023 cohort, which, although in continuity with several choices of the previous one (division into three paths, marked attention to internationalization and work placement activities, etc.), has brought significant adjustments both in the structure (for example, the civil procedural and criminal procedural subjects, until now confined to the fifth year, are brought forward to the fourth, receiving a strong request from the student component), and in the approach, which is summarized below. In the first two years, a homogeneous offer is foreseen, aimed at imparting to all students a solid initial training in the basic areas (private, constitutional, philosophical-legal, historical-legal) and characterizing areas (economic and public, criminal, union, administrative and international). Starting from the third year, a wider range of choices opens up to the student, which distributes the teachings among three paths within which he can orient his individual study plan based on cultural interests and expected professional specialization. Alongside the foundational teachings that necessarily remain homogeneous (basic courses in the commercial and labor fields, the legal English course, those in procedural law, etc.), others are foreseen that are more specialized and adherent to the specific contents of each path. Both related and integrative disciplines, grouped in blocks of different teachings for each path, and various advanced courses of basic and characterizing activities (e.g. comparative subjects, or advanced courses in the civil, criminal and commercial fields) are dedicated to this purpose. The first path is of a Classical nature, generally oriented towards the traditional aspects of legal knowledge, but also rich in specialized teachings, capable of opening up to new areas of knowledge required by the professional world (e.g. ADR, Antitrust, Artificial Intelligence, etc.). The second path is called Environment Territory Innovation, and is aimed at enriching the training of the jurist with skills that are now essential for operating within public administrations, law firms, judicial offices and the productive world. The training in the field of environmental law (constitutional environmental law, administrative environmental and energy law, criminal environmental law and fight against eco-mafias, etc.) has a solid connection with the lines of research of many professors on the legal implications of sustainable development, the environment and the agri-food sector, and creates a bridge to the Department's PhD in Law and Sustainability. The training in the field of digital innovation (consumer and digital market law, constitutional law of digital information, etc.) is now being strengthened, in a complementary way, in order to adapt the teaching contents to the transformations that, especially in the post-pandemic scenario, will mark an irreversible turning point in the market of goods and services. In fact, it will be largely up to the legal professional to govern this change with new tools, legal categories and methodologies for managing conflicts. The third path is the European and International one. It allows to orient the contents of all subjects in the key of the approach to supranational and community sources (e.g. comparative and European constitutional law, European private law, European criminal justice, etc.), exploiting once again the international vocation of the research carried out by many affiliated professors. At the same time, a rich basket of courses entirely taught in English is offered, which however, by explicit choice of the Degree Course, are not confined exclusively to the European and International track, but transversally cross the three addresses, allowing each student who intends to internationalize his study plan, regardless of the chosen track, to include them in his curriculum. Another and fundamental aspect is the provision, in the last two years of studies, of various practical laboratory activities useful for accompanying towards the world of work. In the fourth year, laboratories are planned such as those on legal writing and use of databases, accounting and balance sheet exercises, trusts and patrimonial destinations. In the fifth year, in addition, the student can opt either for an external internship (which is also equated to the early semester of legal practice, made possible by a special agreement with the Bar Association of Lecce), or for the performance of additional laboratories activated in procedural matters (civil, criminal and administrative, according to the choice made by the student): within these laboratories, simulated trials are held, in which students are trained to draft defense documents, sentences and other procedural documents. The purpose of the significant strengthening of practical activities is, among other things, to adapt the educational offer of the Universities to the needs of the judicial system, including the training of graduates who can enter the ranks of the Process Office with already solid application bases: this need is strongly indicated in the strategies of the PON Governance and Institutional Capacity 2014-2020, together with that of orienting the skills of the jurist towards the digital and technology sectors. To these requests, with the described redefinition of the legal studies plan, the Cds intended to respond, for the part of its competence, in an immediate and exhaustive way, outlining a package of skills immediately usable, after graduation, both in professional firms and in judicial offices.
To be admitted to the single-cycle Master's Degree Course, you must have a high school diploma or another qualification obtained abroad, recognized as suitable.
A good general culture is also required, particularly in the historical-institutional field and the history of thought, accompanied by a marked aptitude for abstract and sequential reasoning and a developed ability to work on complex written texts, as well as elements of knowledge of foreign languages.
Enrolling students will have to take an assessment test, the outcome of which is not binding for the purposes of enrollment, aimed at providing general information on the student's aptitude to undertake the chosen studies and on the state of the basic knowledge required. Failure to pass the test entails the attribution of an educational debt established annually and remedied by attending a dedicated course, i.e. through a small additional educational obligation.

Functions

The professional figures of lawyer, magistrate, notary will carry out functions characterized by high responsibility and full autonomy, in the various fields of professional activity, ensuring in-depth knowledge of fundamental sectors of the legal system in its main articulations and interrelations thanks to the acquisition of cultural and technical tools specific and appropriate to the special professionalism of the jurist.

Skills

Ability to analyze, evaluate and make decisions of the jurist even outside of knowledge of sectoral content; ability to set up, in written and oral form, arguments appropriate to the correct setting of general and special legal questions, cases and specifics, with critical awareness not only of the technical-legal profiles but also of the cultural and practical ones, with regard to the fundamental values of the legal system and social values; levels of knowledge adequate for a higher legal education as an essential prerequisite for starting the legal professions and the offices of the Judiciary. Theoretical knowledge is combined with strong practical skills, trained through the enhancement of laboratory activities (trial simulations, simulated drafting of documents and opinions, etc.). In terms of content, while maintaining the homogeneity of preparation in the main basic and characterizing subjects, the choice of major may provide the student with more specialized knowledge in the thematic areas explored, respectively, in the Classical major, in the Environment Territory Innovation major, in the European and International major.

Master's degrees in Law, after accessing the School of Specialization for the legal professions and through the completion of the internships required for the various professions, will have the legal right to access the state exam for the qualification to practice as a lawyer, the notary competition and the competition for roles in the judicial system.
To access the final exam, the student must have passed the exams and acquired the
number of CFU required by the regulations. The final exams are held in public. The Master's Degree in Law is awarded following the passing of the final exam which includes the discussion of a written thesis, written by the student on topics related to the knowledge acquired during the entire training course, from which emerges the ability of systematic, critical and argumentative analysis, under the guidance of a supervisor.
The methods, terms and administrative procedures for the assignment and delivery of the theses are published on the Department website.
The judging committees for the final exam express their vote in hundredths and can unanimously award honors to the candidate who obtains the highest score. The minimum grade for passing the final exam is sixty-six
one hundred and tenths.
The topic is agreed with one of the professors of the Degree Course and is related to one of the basic, characterizing, similar-integrative scientific-disciplinary sectors, or, in any case, consistent with the educational objectives of the degree according to the procedure indicated in the Regulations for the degree exam, as published on the website of the Faculty of Law and attached here.
